The form assigns FSMLabs the right to use and incorporate your software.Please read it carefully.---------------------------------------------------------------------------------FINITE STATE MACHINE LABSCONTRIBUTED SOFTWARE LICENSE AGREEMENT This Contributed Software License Agreement ("Agreement") is a legal agreementbetween you and, if applicable, your company ("You") and Finite State Machine Labs, Inc. ("FSMLabs").  This Agreement enables You to submit software You have written ("ContributedSoftware") to FSMLabs for inclusion in FSMLabs' GPL RTLINUX releases ("RTLinux/GPL").BY MARKING "I AGREE", SENDING A COPY OF THIS AGREEMENT TOFSMLABS  AND A COPY OF  THE SOURCE CODE OF THE CONTRIBUTED SOFTWARE  EITHER EITHER ELECTRONICALLY OR ON PHYSICAL MEDIA ,YOU INDICATE YOUR ACCEPTANCE OF THE TERMS OF THIS AGREEMENT. YOU SHOULD THEREFORE READ THIS AGREEMENT CAREFULLY BEFORESENDING A COPY OF THIS AGREEMENT TO FSMLABS.In exchange for FSMLabs' efforts of reviewing and possibly integrating your ContributedSoftware into RTLinux/GPL, You agree to license the Contributed Software to FSMLabs under the terms and conditions of this Agreement as follows:1.1. License.  You hereby grant to FSMLabs a non-exclusive, fully transferable,royalty-free, worldwide, unrestricted, irrevocable license, without any obligation to account to You regarding FSMLabs' activities under this Agreement, to copy, modify,adapt, alter, integrate, use, translate, compile, load, execute, distribute, sell, assign, lease, market, rent, lend, sublicense, transfer, make available, dispose of, or otherwise grantrights to the Contributed Software; integrate the Contributed Software into RTLinux/GPL and/or any other FSMLabs' software or products; create derivative works based on theContributed Software; and create any software by modifying the Contributed Software or that is formed, in whole or in part, by a portion of the Contributed Software. 2.2. Warranty; Disclaimer.  YOU ARE SUBMITTING AND LICENSING THECONTRIBUTED SOFTWARE TO FSMLABS ON AN AS IS BASIS AND FSMLABS HEREBY ACKNOWLEDGES THE AS IS BASIS UPON WHICH THECONTRIBUTED SOFTWARE IS BEING SUBMITTED AND LICENSED TO FSMLABS. (a)You represent and warrant that You have the necessary power andauthority to enter into and perform under this Agreement; and that entry into and performance under this Agreement will contravene no rights orentitlements of, nor constitute breach, of any obligations to, any third parties. (b)The execution and delivery by You of this Agreement and theperformance by You of your obligations hereunder are duly authorized, and do not conflict with the terms of any other contract, agreement,arrangement or understanding to which You are a party.  All necessary action has been taken to make this Agreement a legal, valid, and bindingobligation, enforceable in accordance with its terms.13.3. Limited Liability.  NEITHER PARTY WILL BE LIABLE WITH RESPECT TOANY SUBJECT MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLETHEORY FOR ANY SPECIAL, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION, LOSTREVENUES, PROFITS OR DATA, COST OF PROCUREMENT OF SUBSTITUTE GOODS, TECHNOLOGY OR SERVICES.  4.4. General.  If any provision of this Agreement shall be adjudged by any court ofcompetent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwiseremain in full force and effect and enforceable.  This Agreement shall be governed by and construed in accordance with the laws of the State of New Mexico without regard toconflicts of laws provisions thereof and the parties hereby submit to the exclusive jurisdiction and venue of the federal and state courts located in the State of New Mexico.The parties agree that this Agreement is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written andoral agreements and communications, if any, relating to the subject matter of this Agreement. By marking  the "I agree" line and copying the source code of the Contributed Softwarebelow, You agree to be bound by the terms and conditions of this Agreement, and You represent that You are authorized to accept the terms and conditions of this Agreementindividually and, if applicable, on behalf of your company.
