Sun Microsystems, Inc.Binary Code License AgreementREAD THE TERMS OF THIS AGREEMENT AND ANY PROVIDEDSUPPLEMENTAL LICENSE TERMS (COLLECTIVELY"AGREEMENT") CAREFULLY BEFORE OPENING THE SOFTWAREMEDIA PACKAGE.  BY OPENING THE SOFTWARE MEDIAPACKAGE, YOU AGREE TO THE TERMS OF THIS AGREEMENT.IF YOU ARE ACCESSING THE SOFTWARE ELECTRONICALLY,INDICATE YOUR ACCEPTANCE OF THESE TERMS BYSELECTING THE "ACCEPT" BUTTON AT THE END OF THISAGREEMENT.  IF YOU DO NOT AGREE TO ALL THESETERMS, PROMPTLY RETURN THE UNUSED SOFTWARE TO YOURPLACE OF PURCHASE FOR A REFUND OR, IF THE SOFTWAREIS ACCESSED ELECTRONICALLY, SELECT THE "DECLINE"BUTTON AT THE END OF THIS AGREEMENT.1.  LICENSE TO USE.  Sun grants you anon-exclusive and non-transferable license for theinternal use only of the accompanying software anddocumentation and any error corrections providedby Sun (collectively "Software"), by the number ofusers and the class of computer hardware for whichthe corresponding fee has been paid.2.  RESTRICTIONS Software is confidential andcopyrighted. Title to Software and all associatedintellectual property rights is retained by Sunand/or its licensors.  Except as specificallyauthorized in any Supplemental License Terms, youmay not make copies of Software, other than asingle copy of Software for archival purposes.Unless enforcement is prohibited by applicablelaw, you may not modify, decompile, or reverseengineer Software.  Software is not designed orlicensed for use in on-line control of aircraft,air traffic, aircraft navigation or aircraftcommunications; or in the design, construction,operation or maintenance of any nuclear facility.No right, title or interest in or to anytrademark, service mark, logo or trade name of Sunor its licensors is granted under this Agreement.3. LIMITED WARRANTY.  Sun warrants to you that fora period of ninety (90) days from the date ofpurchase, as evidenced by a copy of the receipt,the media on which Software is furnished (if any)will be free of defects in materials andworkmanship under normal use.  Except for theforegoing, Software is provided "AS IS".  Yourexclusive remedy and Sun's entire liability underthis limited warranty will be at Sun's option toreplace Software media or refund the fee paid forSoftware.4.  DISCLAIMER OF WARRANTY.  UNLESS SPECIFIED INTHIS AGREEMENT, ALL EXPRESS OR IMPLIED CONDITIONS,REPRESENTATIONS AND WARRANTIES, INCLUDING ANYIMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR APARTICULAR PURPOSE OR NON-INFRINGEMENT AREDISCLAIMED, EXCEPT TO THE EXTENT THAT THESEDISCLAIMERS ARE HELD TO BE LEGALLY INVALID.5.  LIMITATION OF LIABILITY.  TO THE EXTENT NOTPROHIBITED BY LAW, IN NO EVENT WILL SUN OR ITSLICENSORS BE LIABLE FOR ANY LOST REVENUE, PROFITOR DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL,INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER CAUSEDREGARDLESS OF THE THEORY OF LIABILITY, ARISING OUTOF OR RELATED TO THE USE OF OR INABILITY TO USESOFTWARE, EVEN IF SUN HAS BEEN ADVISED OF THEPOSSIBILITY OF SUCH DAMAGES.  In no event willSun's liability to you, whether in contract, tort(including negligence), or otherwise, exceed theamount paid by you for Software under thisAgreement.  The foregoing limitations will applyeven if the above stated warranty fails of itsessential purpose.6.  Termination.  This Agreement is effectiveuntil terminated.  You may terminate thisAgreement at any time by destroying all copies ofSoftware.  This Agreement will terminateimmediately without notice from Sun if you fail tocomply with any provision of this Agreement.  UponTermination, you must destroy all copies ofSoftware.7.  Export Regulations.  All Software andtechnical data delivered under this Agreement aresubject to US export control laws and may besubject to export or import regulations in othercountries.  You agree to comply strictly with allsuch laws and regulations and acknowledge that youhave the responsibility to obtain such licenses toexport, re-export, or import as may be requiredafter delivery to you.8.  U.S. Government Restricted Rights.  IfSoftware is being acquired by or on behalf of theU.S. Government or by a U.S. Government primecontractor or subcontractor (at any tier), thenthe Government's rights in Software andaccompanying documentation will be only as setforth in this Agreement; this is in accordancewith 48 CFR 227.7201 through 227.7202-4 (forDepartment of Defense (DOD) acquisitions) and with48 CFR 2.101 and 12.212 (for non-DODacquisitions).9.  Governing Law.  Any action related to thisAgreement will be governed by California law andcontrolling U.S. federal law.  No choice of lawrules of any jurisdiction will apply.10.  Severability. If any provision of thisAgreement is held to be unenforceable, thisAgreement will remain in effect with the provisionomitted, unless omission would frustrate theintent of the parties, in which case thisAgreement will immediately terminate.11.  Integration.  This Agreement is the entireagreement between you and Sun relating to itssubject matter. Capitalized terms not defined inthis Supplement shall have the same meaningsascribed to them in the Agreement. TheseSupplement terms shall supersede any inconsistentor conflicting terms in the Agreement, or in anylicense contained within the Software.1. License to Distribute. Sun grants you anon-exclusive, non-transferable, limited licenseto reproduce and distribute the binary and/orsource code form of the Software to third partyend users through multiple tiers of distribution,provided that you: (i) distribute the Softwarecomplete and unmodified in its original JavaArchive file, and only bundled as a part of yourprogram that incorporates the Software("Program"); (ii) do not distribute additionalsoftware intended to replace any component(s) ofthe Software; (iii) agree to incorporate the mostcurrent version of the Software that was availablefrom Sun no later than 180 days prior to eachproduction release of the Program; (iv) do notremove or alter any proprietary legends or noticescontained in or on the Software; (v) onlydistribute the Program pursuant to a licenseagreement that protects Sun's interest consistentwith the terms contained in the Agreement; (vi)may not create, or authorize your licensees to cr!eate additional classes, interfaces, orsubpackages that are contained in the "java""javax" or "sun" packages or similar as specifiedby Sun in any class file naming convention; and(vii) agree to defend and indemnify Sun and itslicensors from and against any damages, costs,liabilities, settlement amounts and/or expenses(including attorneys' fees) incurred in connectionwith any claim, lawsuit or action by any thirdparty that arises or results from the use ordistribution of any and all Programs.2. Trademarks and Logos. You acknowledge asbetween you and Sun that Sun owns the Javatrademark and all Java-related trademarks, logosand icons including the Coffee Cup and Duke ("JavaMarks") and agree to comply with the JavaTrademark Guidelines athttp://java.sun.com/trademarks.html.
